How did I get into mediation?
About 15 years ago, as a judge, I was offered the opportunity to train as a mediator. Finding solutions without legal judgment? I was skeptical and curious at the same time. Today, I have been working as a dedicated and passionate mediator in court mediation for over 10 years. If you manage to get the parties involved into a dialogue, the solution is usually not far away. Listening to each other, understanding the other person, identifying and expressing your own needs. Discuss with each other what is and is not acceptable, draw boundaries and negotiate possible solutions together that both sides can accept. I am convinced that a judicial process cannot achieve this. In the event of a judgement, there can only be one winner and one loser. In mediation, there are only winners.
We have not been taught how to negotiate with each other. That’s where I want to help. That is why I have also been certified as a mediator so that I can help you outside of my court. I am happy to offer my experience from over 300 mediations.
What characterizes myself as a mediator
I care about people. Understanding feelings and motivations is important to me. Building trust is an important building brick. I’m a good at listening and can also hear the undertones. Organizing the confusion, working out the important points, sometimes setting up rules of conversation and enforcing them- that’s my style. I’m patient but I also want to push forward. Getting the parties to the point where they don’t talk to me, but negotiate with each other on an equal basis to find solutions. That’s what I’m good at.
My focus Areas in Mediation
Construction disputes
I will get general contractors, subcontractors, architects and clients round the table. If necessary, we bring in private experts and liability insurers. Defects, claims for payment for work, supplements, fee issues etc. are negotiated around the table.
Shareholder disputes
Who is accusing whom of what and why. How should the company survive, how its shareholders, managing directors, etc.? Is it about developing future prospects, new rules of collaboration or about leaving and conflicts? Valuation issues are discussed and, if necessary, tax consultants or auditors are consulted. What is feasible is discussed on an equal footing and solutions are developed.
Inheritance disputes
If only the testators knew what problems they have left to their heirs………..! What did the testator want, how should their will be understood? What prior gifts were made. How should inherited property or even the company be valued? What is the compulsory portion worth? Which items are particularly important to whom and have great sentimental value. How can settlements be financed. Who has which interests. Finally saying what has not been said for so many years. In inheritance mediation, there is also room for emotions, but the result requires clear structures and goal-orientated negotiations. With my help, you will find the right approach together.
Splitting up non-marital partnerships
Who contributed what? How do you come apart fairly? Who keeps the house? Which way seems realistic? Under my moderation, you will work out solutions on an equal footing.
And what else?
I used to think that only neighbor disputes and disputes involving personal relationships belonged in mediation. Today, I am convinced that all conceivable disputes can be negotiated as equals using the structured mediation process and brought to a reasonable solution. Anyone who wants to try to talk to each other is in good hands with me.
What I do when I'm not doing mediation
My main professional activity is working as presiding judge of a chamber for commercial matters at the regional court, as arbitrator/mediator and staff representative.
I am married and have a grown-up son.
In terms of sport, I run, row and practise yoga. I enjoy opera and theatre, as well as gardening. I like travelling, especially to Crete. Hiking is also one of my favourite things to do there.
